1. RENTAL TERMS & INVENTORY VERIFICATION

  • Pick-up/Drop-off: All gear must be picked up and returned to the Palm Skies office unless delivery is arranged.

  • Inventory Count & Responsibility: At the time of delivery or pick-up, the customer is solely responsible for counting and verifying the total number of items received. By accepting the items, the customer acknowledges that the quantity is correct and that all items are in good working order.

  • Equipment Care: The customer is responsible for the gear from the moment of possession. Items must be returned in the same condition as received, barring normal wear (sand/water).

2. CANCELLATION & REFUND POLICY

  • Strict No-Refund Policy: All bookings are FINAL SALE. Once payment is submitted, no refunds or cancellations will be issued for any reason.

  • Weather Policy: Palm Skies is not responsible for weather conditions. No refunds will be given due to rain, wind, or surf conditions.

3. LIABILITY, SAFETY & WAIVER OF RIGHTS

  • Assumption of Risk: The customer (and all members of their party) acknowledges that beach activities and water sports involve inherent risks. By renting equipment, the customer voluntarily assumes all risks of property damage, personal injury, or death, regardless of the cause.

  • Comprehensive Release: The customer agrees to release, indemnify, and hold harmless Palm Skies Vacation Services, its owners, and employees from any and all liability, claims, or causes of action for any injury, disability, or death arising from the use of equipment or participation in activities.

  • Alcohol & Substance Use: Palm Skies is not liable for any accidents, injuries, or fatalities resulting from the customer’s consumption of alcohol or drugs. Customers who choose to consume alcohol do so at their own risk.

4. LOSS, DAMAGE & REPLACEMENT POLICY

  • Missing or Damaged Items: In the event that equipment is lost, stolen, broken, or not returned for any reason, the customer is responsible for the full replacement.

  • Replacement Costs: Charges for lost or unreturned items will be calculated as follows:

    1. The Full Market Value (Current Retail Price) of the item.

    2. The Full Shipping Cost to Puerto Rico.

    3. A 30% Administrative & Processing Fee added to the total.

  • Authorization: The customer authorizes Palm Skies Vacation Services to charge the payment method on file for these replacement costs if items are not returned or are returned damaged beyond normal wear and tear.

5. ON-SITE OFFICE RENTALS & SECURITY

  • Full Upfront Payment: Payment must be made in full and in advance. This payment is final and non-refundable.

  • Security Collateral: The customer must provide a valid government-issued photo ID. A copy will be held on file as security collateral until all items are returned and inspected.

6. BOOKING & DEPOSIT POLICY

  • Deposits & Booking: A non-refundable deposit is required to secure any booking. Bookings are not confirmed until the deposit is paid and agreements are signed.

  • "To Be Determined" (TBD) Fees: For services with variable costs—such as luggage storage, where the final count is determined on-site—payments are due at the time the service is rendered.


  • CUSTOMER ACKNOWLEDGMENT

    By checking the box, I acknowledge that I have read and agree to the terms listed. I specifically understand and agree that all payments are non-refundable, I waive my rights regarding liability for injury or death, and I am responsible for the replacement cost plus the 40% fee for any lost or damaged equipment.
